This Service Agreement ("Agreement") is entered into between Pools Covered S Corp, doing business as Alpine Pool Covers and/or Pools Covered ("Company"), and the client identified at the time of booking ("Client"). By scheduling, accepting, or paying for services, Client agrees to be bound by this Agreement.

1. Services

The Company provides pool cover services as described in the applicable service order or booking confirmation, which may include cover cleaning, system tune-up and adjustment, UV treatment, bearing replacement, cover repair, and related maintenance services. The Company reserves the right to decline or discontinue services at any time for any reason, including unsafe conditions or nonpayment.

2. Scheduling and Access

Client agrees to provide safe, clear, and unobstructed access to the pool cover system on the scheduled date. If access is denied or service cannot be completed due to Client's failure, a trip charge or cancellation fee may apply. The Company is not liable for delays caused by weather, traffic, or other circumstances beyond its control.

3. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. In the event of nonpayment, the Company may charge a late fee of 1.5% per month on overdue balances, suspend future services, and pursue collection including recovery of attorney fees and court costs.

4. Warranty

The Company warrants its workmanship for six (6) months from the date of service. This warranty covers defects in workmanship directly related to services performed. It does not cover normal wear and tear, damage caused by misuse or neglect, pre-existing conditions, severe weather, or parts supplied by the Client. The Company's sole obligation under this warranty is to re-perform the defective work or issue a credit toward future services.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

6. Client Responsibilities

Client agrees to: disclose any known pre-existing conditions prior to service; ensure the service area is safe and free from hazards; keep children and pets away during service; provide accurate property information; and notify the Company of concerns within 7 days of service completion.

7. Property Damage

The Company carries general liability insurance. Client must notify the Company in writing within seven (7) days of the service date of any damage directly caused by the Company's negligence. Failure to provide timely notice may limit or void any claim.

8. Cancellation Policy

Cancellations with at least 24 hours' notice incur no penalty. Cancellations with less than 24 hours' notice may result in a fee of up to $50. No-shows may be charged the full service rate.

9. Governing Law

This Agreement is governed by the laws of the State of Utah. Disputes shall first be submitted to good-faith mediation, and if unresolved, to the courts of Utah County or Salt Lake County, Utah.

10. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions. No modification shall be binding unless made in writing and signed by both parties.

9. Reviews and User Content

If you submit a review or testimonial, you grant the Company a non-exclusive, royalty-free, perpetual license to use and display that content in connection with our business and marketing.

11. Governing Law
